1.DESCRIPTION OF USERS AND ACCEPTANCE OF TERMS

 

This Privacy Policy (“Privacy Policy”) applies to any individuals who use our Services (“Users”), and sets forth and describes the practices that we will follow with respect to the privacy of the information that Users provide to Sency. By accessing and using Sency’s website (the “Website”), application (the “Application”), any use of Sency’s proprietary platform and technology for visual data as a service (including any demos or trials that may be provided) (the “Solution”), and of any services provided by Sency through the Website or Application (collectively, the “Services”).

 

This Privacy Policy applies to information we collect through the Services and via email, text, or other means of communication between you and any employee or agent of Sency. This policy does not apply to the actions of any company or entity that we do not control or to individuals who we do not directly employ or manage.

 

2.TYPES OF INFORMATION WE MAY COLLECT; CONSENT TO USE

 

Personal Information which you provide to us through use of the Services. This is information that you intentionally and/or actively provide to us through your use of the Services (“Personal Information"). Personal Information typically includes names, email address, birthday, gender, phone number, username and password, as well as any information you provide in messages or applications to us such as when you create an account (an “Account”) and/or update your Account details.

 

Personal Identification Information. Some of the information we collect may constitute personal identification information (“Personal Data”) under applicable health and data privacy laws, as amended from time to time. This includes, but is not limited to, any information that can be used to identify you such as your name, contact information, or images and videos of you. To the extent that privacy and data protection laws apply to any information you provide, we will comply with those requirements as well.

 

Personal Information which is automatically collected when you use or access the Services. This is information that we automatically receive upon your accessing or interacting with our Services. This information may include:

 

  • IP address, UDID (Unique Device Identifier) or other persistent user and/or mobile device token, advertising ID, device type, operating system, browser type and version, browser and keyboard language, the User’s ‘click-stream’ and activities on the Services, the period of time the User used the Website and/or Application, and/or related time stamps.

 

  • Geolocational Information – with your consent, we may collect geolocational information from your mobile device, your wireless carrier, or certain third-party service providers (“Geolocational Information”). You may decline to allow us to collect such Geolocational Information, in which case Sency may not be able to provide certain features of the Services to you.

 

  • Motion Analysis Information – with your consent we will collect information from sensors on your mobile device, in order to evaluate your movements and monitor your progress (“Motion Analysis Information”). The Motion Analysis Information is tracked only while the Application is running on your mobile device. You may decline to allow us to collect such Motion Analysis Information, but you understand that if you choose to do so, Sency will not be able to provide certain features of the Services to you.

 

Information From Cookies. Information that we collect using “cookie” technology. Cookies are small packets of data that a website stores on your computer’s or mobile device’s hard drive so that your computer will “remember” information about your visit. We use both first- and third-party session cookies and persistent cookies.

 

Consent to Use. You consent to and agree that, for the purpose of providing the Services, Sency and its affiliates may share certain User Data with the Providers, and that Sency may receive and manage any plans, strategies, recommendations, or other feedback created by the Providers based on User Data for the purposes of providing the Services. If you share any Personal Data with a Provider in connection with the Services, you acknowledge and agree that such Provider’s use of the Personal Data is not subject to this Privacy Policy. The Providers may also share data relating to a User with Sency, but such sharing of information is not governed by this Privacy Policy.

 

Third-Party Analytics. We use third-party analytics services (such as Google Analytics and Mixpanel) to assess your use of the Services, analyze performance metrics, and analyze other information connected to mobile and internet usage. By accessing and using the Services, you consent to these third parties processing the data about you in the way and for the purposes set out in this Privacy Policy.   1. To engage Providers in order to perform certain operations on behalf of Sency. The Providers will only the able to access information to the extent necessary to perform their functions and as permitted by law. We may also share your information with any of our affiliates.

 

  1. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the information may be part of the transferred assets.

 

4.PAIRING WITH A PROVIDER

 

You acknowledge and affirmatively consent to the fact that Sency personnel will, as needed, review your particular reports or forms for any or all of the following reasons: During the process of your enrolment and pairing with a Provider in order to determine whether you are able to successfully engage with the Provider, and if appropriate to transition you to another Provider, who will access only such information that is necessary to provide the Services; if applicable, to review a complaint that you may report about your Provider’s practices; or to address any quality assurance concern(s) raised by you and that may apply to an individual Provider, or a national network issue.

 

5.COMMUNICATING WITH A PROVIDER

 

Users may be able to communicate with their Provider via video or direct messaging services provided by third parties. If you directly communicate with a Provider via such third party services, you acknowledge and agree that none of the information contained in such communications (including, without limitation, Personal Data) is covered by this Privacy Policy and Sency is not responsible or liable for how such information is used, or processed, or for any resulting breaches of Personal Information during transmission of the message.

 

6.ACCESSING AND AMENDING PERSONAL INFORMATION AND CHOICES

 

If you enrolled in the Services and have an Account with Sency, you may access, review, and make changes to your Personal Information by following the instructions found on the Website or Application. You may also modify and manage your marketing and non-transactional communications by clicking on the “unsubscribe” button located at the end of any marketing email sent by Sency. We will use commercially reasonable efforts to timely handle your requests. You cannot opt out of receiving e-mails related to your Account.

 

7.HOW WE PROTECT THE INFORMATION

 

We take commercially reasonable steps to protect the information we collect from loss, misuse, and unauthorized access, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. Therefore, take special care in deciding what information you provide.

 

8.CHILDREN

 

We do not knowingly collect personal information from children under the age of eighteen (18) years of age. If you are under 18, do not use or access the Website, Application and/or the Services, and do not provide us with any information. Without relieving you of your responsibility to comply with the Terms of Use and the terms hereof, we reserve the right, at our sole discretion, to request proof of age at any stage so that we can verify that no one under the age of 18 is using our Services. If you have added and listed a User under the age of 18 you hereby declare to Sency that you are the parent or legal guardian of such User with sufficient rights to do so. Should we learn that a person under 18 is using the Services in violation of the abovementioned terms, we will use our best efforts to prohibit and block such User from accessing our Website, Application and/or the Services, and will use our best efforts to promptly delete any User Data, including Personal Data.

This Privacy Policy is effective as of the date included above, and we may amend it from time to time. We will post any updated Privacy Policy on the Website or Application as soon as it goes into effect.
